Separated parents sharing responsibility for a child need to decide who will hold the active Tax-Free Childcare account. Shared care does not give each parent a separate top-up allowance for the same child.
The official application guidance says parents who are jointly responsible should agree who applies. If they cannot agree, both should apply separately and HMRC decides. This is a dispute-resolution process, not permission to run two active accounts.
HMRC’s rules for more than one eligible person also cover a new application when another parent already holds the active account. Contact HMRC before changing existing arrangements.
The applicant must meet the eligibility conditions, including the child usually living with them. A new partner living with the applicant may need to be included. Do not assume separation by itself makes either parent eligible, or that payment of maintenance determines the account holder.
HMRC’s qualifying-payment guidance permits qualifying payments by the account holder or another person. Contributions share the same child’s allowance. Agree how to fund the account and keep records of deposits and provider payments. A contribution does not make someone the account holder.
Suppose an eligible child has an £800 bill, no available balance and sufficient top-up allowance. The total personal deposit needed is £640 and the government adds £160. If the parents agree to split the personal contribution equally, they each contribute £320. This is an illustration of their chosen split, not a maintenance calculation or a required arrangement.
If only £60 of top-up allowance remains, the total deposit rises to £740, or £370 each under that same agreement. Splitting payments does not create another £500 allowance.
Tell HMRC about relevant changes and ask how to proceed if the account holder should change. Do not close an account or withdraw its balance just to resolve an ownership dispute. Provider refunds need to return to the original childcare account.
